Welcome to TerraBytes. These Terms of Service ("Terms") are a legal agreement between you and TerraBytes B.V. ("TerraBytes", "we", "us"), a company registered in Amsterdam, the Netherlands (KvK 98559931). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.

How our terms fit together. TerraBytes B.V. works with three layers of terms: (1) these website Terms of Service; (2) the End User License Agreement (EULA) you accept in the TerraBytes application when you install and use the software; and (3) the NLdigital Terms 2025, the general terms for the digital sector that govern every TerraBytes B.V. license agreement and that our contracts and correspondence refer to. Where a signed License Agreement conflicts with the NLdigital Terms, the License Agreement prevails; anything not addressed in the License Agreement is governed by the NLdigital Terms.

1. Acceptance of Terms

By creating an account, accessing our platform, or using any of our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

TerraBytes provides a data storage optimization platform that helps organizations analyze, manage, and reduce their data footprint through intelligent insights, automation, and sustainability tracking. Our services include:

Storage analysis and recommendations
Data cleanup and archival tools
Carbon impact tracking
Integration with cloud storage providers

3. User Obligations

You agree to:

Provide accurate and complete information during registration
Keep your account credentials secure and confidential
Use the service in compliance with all applicable laws and regulations
Not misuse, disrupt, or attempt to gain unauthorized access to our systems
Not use the service for any illegal or unauthorized purpose

4. Data and Privacy

We process your data in accordance with our Privacy Policy. You retain ownership of your data. We only access metadata necessary to provide our services unless you explicitly grant additional permissions.

5. Intellectual Property

All content, trademarks, logos, and intellectual property related to TerraBytes are owned by or licensed to TerraBytes. You may not copy, modify, distribute, or reverse-engineer any part of our platform without prior written consent.

6. Limitation of Liability

To the fullest extent permitted by law, TerraBytes shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability shall not exceed the amount you paid for the service in the preceding 12 months.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or experience outages without prior notice.

8. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in prohibited activities. You may terminate your account at any time by contacting us at info@terrabytes.app.

9. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through our platform. Continued use of our services after changes constitutes acceptance of the updated Terms.

10. General Terms (NLdigital Terms 2025)

All license and service agreements between TerraBytes B.V. and its clients are governed by the NLdigital Terms 2025, the standard terms for the Dutch digital sector. These apply in addition to the commercial and product-specific arrangements in your individual License Agreement and are referred to in our contracts and correspondence. 11. Governing Law

These Terms are governed by the laws of the Netherlands. Disputes arising under the NLdigital Terms 2025 are resolved by arbitration under the Regulations of the Foundation for the Settlement of Automation Disputes (SGOA), as set out in those terms. Applicability of the Vienna Convention 1980 (CISG) is excluded.
